各種建築標準和法規都可以實現可持續發展的環境，而這些標準規則和法規為建築合規，從規劃、設計、施工到竣工使用期間，提供了一個強制性的法律框架及管理流程。本研究基於1995 - 2023年間共有226起(N=647) 案例造成建築合規風險的刑事案例數據庫，尋求建築行為人若造成建築合規風險與其過失致死責任案例之間建立潛在的因果關係 ，並運用被稱為數據挖掘(Data Mining)方法分析，來探究台灣建築合規風險與過失致死責任案例的原因和分佈，結果表明建設行業中無論於拆除、營造之時或是建築已完竣時，風災與地震的發生規律是建築合規風險發生的關鍵因素。研究發現人員被依法究責刑法中過失致死責任罪之罪責，主要是:(1)因建築行為人未持證執行業務，營造未經過整體結構安全評估，並且過程中並無任何預防措施或補強；(2)法院如果採簡易審判程序，對於建築行為人有建築合規風險之司法權益的風險；(3)違章建築的違規營造，亦容易構成建築合規風險的刑事罪責。經過專家訪談後表明，對於台灣建築行業的建築行為人在執行業務時，提出了需要特別注意合規風險的事項，能提高各該行為人之合規工作的水準與能力，並且對於實現可持續發展的工程環境，做為台灣建築主管機關在執行建築管理流程中，提供了一個至關重要的修法監督的架構。

Construction standards and regulations can be used to create an environment conducive to sustainable development. These standards and regulations provide construction activities with a mandatory technical and legal framework from planning, design, and construction to completion of construction. This study is based on a criminal case database of 227 (N=647) cases that caused construction compliance risks from 1995 to 2023 and seeks to establish a potential causal relationship between construction compliance risks caused by building implementers and gross negligence manslaughter liability cases. It also used data mining analysis to explore the reasons and distribution of construction compliance risks in the construction industry in Taiwan. The results showed that in cases of demolition, construction, or completion of construction, the occurrence of natural disasters and earthquakes is a key factor in construction compliance risks. The study found that the main reasons by construction implementers bear construction compliance risk responsibilities according to law include: (1) Failure of professional technical personnel to provide services with licenses which leads to failure to implement safety evaluation for the overall structure in the construction process and failure to take any preventive measures or enhancements in the process; (2) Risks to legal rights of construction implementer for VERC if the court adopts simplified judgment procedures; and (3) Construction of illegal building structures could easily result in VERC liabilities. This finding, after interviews with experts, suggests that construction actors in Taiwan's construction industry need to pay special attention to compliance risks when performing business. This can improve the level and ability of each actor's compliance work and contribute to the realization of sustainability. The sustainable development of the engineering environment provides Taiwan's construction authorities with a crucial framework for legal revision supervision in the implementation of the construction management process.
