有關成效式契約發展上，應用較成熟方面偏向設備類型的契約，
例如電機設備維護等，因其風險較小、可控性較高，因此執行起來較
為容易，針對成效式契約應用於道路養護中，據國外過往經驗，大多
數均應用於公路居多，例如美國的跨城市公路，其道路性質較為單純，
較無其他不可控因素或未知風險，相較於市區道路養護來說，因常有
管線挖掘、交通政策等因素，使得成效式契約的應用較為困難。
桃園市自民國 109 年領先全國成功引用成效式契約應用於市區
道路養護範圍，本研究透過實際執行過程中的履約管理，來了解其執
行上的優勢及劣勢，將優勢再強化並修補劣勢，在已經研擬完成並成
功應用的契約條件下，彙整成效式契約應用帶來的好處並同時讓契約
執行的內容能更加成熟，為日後成效式契約的發展更能廣為運用。
本研究不僅探討成效式契約應用於市區道路養護管理的好壞處
外，亦將廠商如何有效的執行並符合機關、廠商及民眾的三贏狀況彙
整，讓各級機關及各地區的在地廠商能更加瞭解此種新型態契約所能
帶來的益處。

In terms of the development of performance-based contracts, the more
mature application is biased towards equipment-type contracts, such as
electrical equipment maintenance, etc., because of their low risk and high
controllability, it is easier to implement. The application of performancebased contracts to road maintenance , according to foreign past experience,
most of them are mostly used on roads. For example, the cross-city roads
in the United States are relatively simple in nature, and there are no other
uncontrollable factors or unknown risks. Compared with urban road
maintenance, it is often There are factors such as pipeline excavation and
transportation policies, which make the application of effective contract
more difficult.
Taoyuan City has taken the lead in the country since the Republic of
China in 109 and successfully applied performance-based contracts to the
scope of urban road maintenance. This study uses the performance
management in the actual implementation process to understand the
advantages and disadvantages of its implementation, strengthen the
advantages and repair the disadvantages. Under the conditions of the
contract that has been researched and successfully applied, the benefits
brought by the application of the effective contract are integrated and the
content of the contract execution can be more mature, so that the
development of the effective contract can be more widely used in the future.
This study not only discusses the advantages and disadvantages of
applying effective contracts to urban road maintenance management, but

also summarizes how manufacturers can effectively implement and meet
the win-win situation of government agencies, manufacturers and the
public, so that local manufacturers at all levels and in various regions A
better understanding of the benefits that this new type of contract can bring.
